There is No way You can buy stock which is trading in Upper circuit. The only way you can buy the stock is AMO (After market order). AMO is placed after market. But the only problem with AMO is you will be getting shares in your account at market price, means as soon as market opens the stock will in your demat!

What happens if I dont sell MIS shares?

In situation 1 if you sold your share in same day it will be automaticaly consider as intraday trading and charges will be according to i.e intraday charges. And in situation 2 if you didn’t sold your share it will be automatically sold off at 3:00 pm on market price.

If the order is not squared off by the user or converted into other order types, the RMS system shall automatically square off the order a few minutes before the market close.

On settlement day you have to give delivery if you fail to do so,then you are at default. Such stocks will go for auction and we know the price war in auction sale.
